Digital Millennium Copyright Act (DMCA) Compliance

Austin Here I Come® respects the intellectual property rights of others and abides by the federal Digital Millennium Copyright Act ("DMCA") by responding to notices of alleged infringement that comply with the DMCA and other applicable laws.

As part of our response process, we may remove or disable access to material on a site controlled or operated by Austin Here I Come® (such as http://www.austinhereicome.com) that is claimed to be infringing. When we do, we will make a good-faith attempt to notify the person who submitted the affected material so that they may submit a counter-notification, as described below.

Austin Here I Come® does not control content hosted on third-party websites and cannot remove content from sites it does not own or operate. If you are the copyright owner of content hosted on a third-party site and have not authorized its use, please contact the administrator of that website directly.

Before submitting a Notice of Infringing Material or a Counter-Notification, you may wish to consult a lawyer to better understand your rights and obligations under the DMCA. Notice to Copyright Owners

If you believe material posted on or linked to or from this Website infringes your copyright, please submit a written, signed notice ("DMCA Notice") to our designated agent using the contact information below.

Important: Under federal law, you may be held liable for damages and attorneys' fees if you make material misrepresentations in a DMCA Notice. If you are not sure whether content on this Website infringes your copyright, consult an attorney before submitting a notice.

Your DMCA Notice must include:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;

Counter-Notification

If you believe material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent. Your counter-notification must include:

  • Your physical or electronic signature;

  • Identification of the material that was removed or disabled, and its location on the Website before removal;

  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;

  • Your name, address, and telephone number; and

  • A statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., a district where Austin Here I Come® may be found), and that you will accept service of process from the person who submitted the original DMCA Notice.
     

Upon receipt of a valid counter-notification, we may, at our discretion, restore the removed material within 10–14 business days, unless the original complaining party first notifies us that they have filed a court action seeking a restraining order against the alleged infringer.
